In general I am very much against censorship however this is NOT a tribe for arguing the premiss and anyone who does so will be kicked off. (You may advertise a tribe here, that has been created to disagree with us. But keep it short.)

Useful constructive criticism intended to improve our ability to achieve our ends is welcome.

If you choose to join us, Your mission is to find articles and news that will help to educate us, as well as organizations that support our cause. And to help bring in more people thru email, Tribes and other social networks. If we are successful I will start a website to continue the work.
It is my intention that we will never ask for cash donations and that this will be an all volunteer organization.

Orphan Works Bill: Government Geared To Exploit Artists!

Imagine a world where the things you made belonged not to you, but to someone else - unless you paid for the right to own them first. Under the Orphan Works Bill, anyone who produces a creative work would have to pay exorbitant sums of money for the simple act of creating art and for the continued ownership of their art through unending copyright registry fees.

This is what the Orphan Works Bill proposes: the bill proposes that as soon as any work of art is created, it would be required to be registered for a moderately high fee with ALL of SEVERAL copyright houses and entered into a giant database. Anyone who does not do this would risk any creation being taken and sold by someone else, and that would be legal because ALL UNREGISTERED WORK would be considered ORPHANED. This includes such simple things as family photos - if posted on the Internet and not registered with a copyright database, your photo album could be used in a series of ads by a major corporation for their latest campaign - and: 1) there would be nothing you could legally do to stop it, because 2) they could legally own your art just by registering it first, and 3) they wouldn't give you a dime. The only way you would regain control of your art is if the previous owner of the copyright allows it to lapse, thereby providing you the opportunity to purchase it.

The OWB extends to all the arts: illustration, photography, computer, mixed media, jewelry, ceramics, acting, performance art, singing, song writing, sculpting, costuming, etc., ad nauseam. It requires the constant registering of any artwork, over and over, ad nauseam; otherwise, your work *could* be used and sold by the government - which will own and run the giant registration companies and databases - for profit. And there is nothing you *would* be able to do about it - ever.

This adds up to a lot of money very quickly - for those who make art and register it, and for those who stand to profit from unregistered art. And not only that, but remember that the copyrights must constantly be renewed as proposed by this bill. Dare I say it? The Orphan Works Bill seeks to totally disempower any creative process in the entire United States of America.

Excerpt from The Illustrators' Partnership Orphan Works Blog, dated September 23, 2008:

Is it wise to concentrate our nations’ copyright wealth in the hands of a few corporate databases? With the meltdown on Wall Street, this might be a good time to ask Congress that question.

The Orphan Works bill would pressure copyright holders to subsidize the start ups of giant commercial databases. The contents of these databases would be more valuable than secure banking information. Yet who can watch the ongoing failure of investment banks that were “too big to fail’ without asking why government should want to create these privately owned image banks on the backs of small business owners who neither want nor need them. Here are some of the questions we’ve raised before about this bad legislative scheme:

• Who’s to be trusted with these databases?
• Who’s to manage them and in whose best interests?
• What happens when a database is hacked?
• What happens when one fails?
• What happens when one is acquired?
• What happens when the terms of service are changed?
• What happens when registration fees become prohibitive?
• What happens when maintenance fees are piled on?
• What happens when exorbitant commissions are imposed?
• What happens to artists who can’t afford to register?
• What happens when registered artists can’t afford to maintain their registrations?
• Will artists have to register their immense bodies of work in competing registries?
• What happens to your business when your clients start calling the databases, not you, to clear rights to your work?
• Why should small business owners be forced to entrust their business information to outside business interests?

Don't delay! Read the latest updates and archives on the Orphan Works Bill at The Illustrators' Partnership Orphan Works Blog found at: ipaorphanworks.blogspot.com/ - and inform yourself. Take it one step further and write to Congress using their handy link to do just that! The more people that know about and speak out against this Bill, the more Congress and your representatives will hear the people's voice and be moved to act in our interest. Our interest is presumably what got them into office, so presumably it is what keeps them there as well. Let them know what you think of the Orphan Works Bill!

If you have never written to Congress, it is easy! Short, one-page letters are highly recommended. See this helpful and simple to follow article on writing guidelines from about.com: usgovinfo.about.com/library/...0199.htm. Another article at itfs.org/webnow/licens...o_congress.htm provides a fast look-up for all your representatives addresses, and suggests that posted letters are much more likely to be recieve attention than emails - as do the guidelines at the United Nations Association of the United States of America (www.unausa.org/site/pp.asp).

***

To put the notion of the Orphan Works Bill into a perspective that has immediate relevance to lots of people on tribe, I'll ask you this: What would Etsy buyers - and more especially sellers - do if this bill was to pass?

Most artists can just afford supplies and a little self-promotion time - let alone registering EVERY SINGLE ITEM of their creation with SEVERAL copyright institutions.

Own your art!

How lovely that HP discontinued their scanners but never recalled them and so I cannot just get another one or even get my money back. That means that eventually when I make some decent income, it is time to get another scanner.

What scanner would you artists recommend (with the exception of HP brand...that was the last straw and they are now on my s*** list)? I would like something that allows the lid of the scan area to be detachable for scans that are much larger than the scan area. A compact one would be good as well.

Until then Ill do the best I can to make my traditional medium works look decent with this printer/scanner/fax combo of mine which I have never used to scan images before. Wish me luck.

Basically my external hard drive was originally NTFS and it isnt the most stable. Of course M$ never mentions it despite that many people have hard drives bigger than 35Gigs now and still are led to believe that NTFS is the only way. Yes, I was ignorant but if M$ had not tried to persuade its customers to go away from FAT32, I (and countless others who have had this happen) would of been less likely to use NTFS. Doh!

As a result, the equivalent of a child running rampant in Daddy's office occurred. Picture a little Bill Gates running to your file folder drawer and tossing up all your file folders into the air and causing all your papers in their corresponding folders to now have to be reorganized and arranged in your file folders.

Now you can guess what I would want to draw. :)

Attempting to create one single image, 1000 x 1000 pixels in size, through the collective contributions of 1,000,000 people. Each person chooses one single pixel and personalizes it by giving it a name, choosing its color and optionally a comment or quote for the rest of the world to see. The theories are countless. Many first thought the result will just be a collection of random pixels. However as the image slowly appears it makes one wonder “what will the image actually become?” Only one million people contributing to the one simple pixel project can answer that question.

The selection for this year's festival has begun, Noorderlicht welcomes submissions and ideas from all over the world

Visit www.noorderlicht.com for conditions and more information

Deadline for submissions: March 1, 2007
Act of Faith
14th Noorderlicht Photofestival
Location: Groningen, The Netherlands
Period: September 16 through October 28, 2007
Opening: Saturday September 15

In one guise or another, religion currently pervades discussion. In a fire fanned by fear of Islam, resorting to religion has become acceptable in the West too.

Faith is back with a vengeance - as a source of certainty and stability, a safe haven, a refuge with its own norms and values, closely connected with the idea of a closed society that is based on tradition and brotherhood.
But what happens when this faith comes in contact with the surrounding world, an open society that is continually changing, based as it is on dialogue among various opinions? Ultimately the separation of church and state is one of the basic principles of Western society, and a globalized world, with its free exchange of goods and ideas, is a source of heresy.

God and Allah, the Vatican and Washington, holy scripture and law books, global and local, love and resentment: The Noorderlicht Photofestival 2007 investigates what happens when faith meets the world around it, where the collisions of different value systems lead to friction.

Act of Faith is an international group exhibition that will be accompanied by a special catalogue. Previous main exhibitions of the festival have drawn enthusiastic responses and are now touring all over the world.

Submissions can be sent directly to the curator: wim@noorderlicht.com
Announcing the launch of my FREE Seth D8 art print source!

As an artisan I have two categories I work in, digital illustration and commercial graphic design. I have chosen to freely share my digital illustration with anyone whom would like a print. I have plenty of commercial clients to satisfy my financial needs, plus I know I will always have all of needs met in every way before I have even asked. I love sharing my digital illustration because when a person is drawn to a piece incidental love is created and the love of creation is reflected back to me. And I love, LOVE!

I have uploaded a large selection of my digital art in hi resolution format to shutterfly.com, I have also set up a page their to access and order the prints. They offer everything from 4x6 prints to 24x36 inch prints in amazing detail and color. You can even create your very own Seth D8 art book of your favorite pieces, all for very reasonable rates. The only cost involved is the production of the prints, and I do not get a cut or add a commission to the service. It is at cost, and my art is completely free for personal use.

Please feel free and browse my current selection and get prints of anything you like, and the best part is you get to be part of the creative process by choosing exactly the correct size and media to suit your need. I will be uploading new hi resolution images a couple times a month so be sure and subscribe to my new Artisantastic illustration RSS feed. When I produce a new image it is immeaditly added to the feed, so you will always be up to date with my latest creations. And believe me I am a prolific artist creating new pieces on a daily basis.
Denver, CO
http://www.zhibit.org/ad/tribe/jgriffin

Jeanne Griffin was born in Colorado and has always felt connected with the creative verve and fortunate synergy surrounding Denver’s art community. She graduated from the Colorado Institute of Art in 1989 and began designing and selling handmade jewelry to Denver's elite boutiques. She became aware of Denver’s lively version of Bohemia in 1990 when she moved to the “dilapidated blight” (as one city official referred to it) now known as LoDo. At that time, the neighborhood still held Denver’s flourishing arts district with over 15 galleries on 3 blocks and home to the original First Friday Art Walk. There was not a sports bar to be found, the viaducts still brandished their seedy, mysterious charm, and art studios were cheap and plentiful. The unmistakable synergy began almost immediately when Griffin rented her first “studio” (a 10 x 10 chicken wire storage cage, in the basement of RedShift Framing) shortly before Core New Art Space leased the 1 st floor as their new gallery. Her “apartment” was across the street on the 2½ floor of the Wazee Supper Club, in a space that had been home to Westword's offices just months before. The atmosphere and community gave her a sense of belonging and encouraged her passion.

She has participated in juried exhibitions and group shows locally and has opened her own gallery where she has hosted 2 solo exhibitions. Her work has received accolades, awards, and press recognition. Currently included in numerous private collections she hopes to win some public art commissions in the near future as well. Her M.O. shifts between painting in acrylics and sculpting i bronze. She also loves to explore and experiment with other mediums, including watercolor, oils, charcoal, pen-and ink, and fiber. Her latest body of work, Bound, represents 2 years of obsessed dedication and has convinced Ms. Griffin to pursue her art full-time.

I am still very much interested in what photographers and artists feel about the “digital transition”- from the chemical/mechanical process to a digital one- and how the resultant affects may be reflected, particularly in the area of fine art photography, in the near future. I believe we are still in the first part or initial phase of major changes in this field.

Some of these changes may be subtle but overall I believe they are bound to be very profound in many ways- from how work is created (captured, processed, printed, etc.) to the way it is presented, transferred, stored and so forth.

Many photographer-artists I see are still simulating Chromogenic photographic prints with their digital prints and processes and for some the “photoshopped” or heavily manipulated image already appears dated and stale, so…

what do you think the future may hold, what direction will artists and photographers turn in this creative area, aesthetically or otherwise?

anyone is encouraged to post their ideas here and/or if they have a serious interest in this area may contact me directly-
Date: February 27, 2006 10:32:46 AM PST
To:
Subject: The Orphan Works Express

FROM THE ILLUSTRATORS’ PARTNERSHIP

The Orphan Works Express

Congress is scheduled to commence Orphan Works hearings the first week in March. They hope to pass legislation before the end of the year. According to a source on the committee, this proposal is being fast-tracked because lawmakers think it has wide-spread support within the creative community. We need to disabuse them of this notion.

The spin that’s being put on this legislation is shrewd. Special interest groups have re-defined copyright users as “creators” of “transformative works.” They're trying to persuade lawmakers that these “creators” - and therefore, creators in general - are being hampered because of obsolete protections on work which has “little or no commercial value.” Yet the omnibus measures proposed in this Report would affect any work - old or new –that’s been published without identifying information. This would apply disproportionately to illustrations and photographs. We need to make it clear to congressmen that these interest groups do not speak for real creators and that our work has significant commercial value.

Orphan Works legislation would be retroactive. This means that all the work you’ve done during the last 28 years could fall into the Orphan Works category if it was ever published without “relevant information” on it, was improperly credited or had been re-published by others without credit. In other words, it would take only one copy of any picture you’ve ever done – published without “identifying information” on it - or with that information removed by others – to justify an infringer’s claim that he was unable to locate the author. The same thing would be true, of course, for future work.

Disputes over infringement would have to be settled in court. (And remember, copyright law is a Federal law, which means Federal court.) The worst thing that could happen to an infringer –if detected - is that a court might make him pay you a “reasonable fee.” This means there’d be no real downside for infringing. For 28 years (since the 1976 Copyright Act went into effect), you’ve been told that your work was protected “from the moment you put pen to paper.” No more. And artists who for 28 years produced work with the confidence that it was protected by that promise will find that the promise has been repealed. In effect, you could now be penalized for having believed what the government told you for the last three decades.

The plan in a nutshell. For years, Free Culture advocates such as Creative Commons have been arguing that the US should lead the way in re-imposing copyright “formalities” such as marking and registration. This would aid the spread of “free culture” because most artists would fail to mark and register their work (or marks could be removed). This would make a vast number of illustrations and photographs royalty-free for anyone to use - or for companies like Google to sell access to.

Unfortunately for the free culturists, the US can’t re-impose formalities without violating or withdrawing from the international Berne Convention, which forbids formalities. And if the US did opt out of Berne, our country would effectively become a copyright outlaw. That would hurt American trade.

So the Copyright Office has crafted their orphan works proposal as a “limitation on remedies.” This would not re-impose formalities. But it would remove or emasculate penalties for infringement, potentially in any case where an illustration or photograph was published without “relevant information” on the picture itself. In effect, this would force artists – as a hedge against infringement – to re-impose on themselves the “formalities” the government can’t. Any artist who didn’t mark his work would expose it to no-fault infringement - a very clever way to re-impose formalities without actually putting it in writing.

Remember, this is all being done in the name of promoting creativity by artists. That’s why we, as artists, will have to speak up in numbers. We have to show lawmakers that the Free Culture movement - and the creative wannabes who comb the internet looking for royalty-free work - do not represent the true creative community. We have to say that this legislation would do great harm to our ability to create and make a living from our work.

What you can do. In their effort to speed this legislation through Congress, the plan's shepherds are severely limiting testimony for and against it. That’s why your letters are important. Write to the senators and congresspersons who will be voting on this legislation, and do it as soon as possible. Express yourselves directly and frankly. You don't have to write a complicated letter, but it's important that you make certain points:

-Make it clear that you’re an artist and that you believe your small business will be endangered by placing limitations on remedies for infringement.

-Make it clear that you will never have the resources to police infringement of your work - which could occur at any time anywhere in the world.

-Make it clear that your work could be orphaned by others, no matter how diligently you do the right things to protect it.

-Make it clear that your work has significant commercial value.

For artists, this legislation would be a major revision of copyright law. The Orphan Works Report calls for a 10 year “sunset provision,” which means that Orphan Works legislation – once passed - will not be subject to reconsideration for another10 years. But if your copyrights have been laundered into the public domain during that decade, they’ll be lost to you for good as surely as the income that will be lost with them. And after 10 years of copyrighted work turning royalty-free, the market for art will be so deformed – and expectations in the marketplace so settled – that there’ll be no going back. We can’t wait until this law gets “reviewed” 10 years from now to express ourselves on it.

The government should not be allowed to create a royalty-free stockhouse out of artists’ work. Please write as soon as you can.

I'm a newbie when it comes to selling my art so I figured I'd ask some of you who probably have way more experience.

Basically I'm wondering this:

Since our work is digital and can be reproduced infinitely how do you guys sell your stuff at any kind of a good price? Do you limit your printings and do it that way?

Also what kind of printer or facility do you use for the printing. I've heard that there are some pretty fancy processes out there that create "museum quality" printouts, whatever that mean.

Anybody know the answers to these kinds of questions?

Thanks!

A bit about me. I am an intelligent, creative, talented and computer-savvy woman. I am a power user of Photoshop, and also knowledgeable in other digital paint/design tools. I have several advanced degrees, including one in Fine Arts, and one in Urban Policy. Also, I have both studied and worked as a physical sculptor. I am actively showing my artwork both nationally and internationally. (You may see my latest painting/photo work at www.jillahlstrand.com).
My management skills could also be of use, as I have honed them in the pursuit of my own business, as well as the management of large government projects.

Greetings,

I'm new to the group so forgive me if this topic has been discussed before. I am in the market for a 20" LCD Monitor. There is no computer store within easy driving distance of my home (I live in rural area), so I can't go and look at different models to compare them.

Going on their past reputation for excellence in graphics monitors, I purchase a LaCie 20" monitor last week. Unfortunately, this monitor is not at all suitable for my digital art. It is so ultra sharp it causes distortions and artifacts in my artwork when I blow up a large 300 dpi image to 100%. It almost looks as though someone used the Uhsharp Mask filter in Photoshop and sharpened things to an extreme that distorts the image.

This monitor may be great for someone who creates work for gaming or video, but for digital art that is going to be printed, it is not workable.

Does anyone have suggestions of other brands of 20" LCD Monitors that would be suitable? I'm on Mac, but would rather avoid Apple's pricey extended warrenty when other companies give a 3 year warrenty for free. Any suggestions?

Thanks,

Hi friends

I thought you might like to know that I've started a Tribe for the discussion and organisation of protests in the London area.

We live in an age of corporate power & dominance, government unaccountability. We need to organise ourselves to let those at the top know we will not stand for the commercialistion of Planet Earth.

It is predicted that unless we change the way we ’re living, we will destroy the Earth and ourselves within the next 1,000 years (Terence McKenna). I don't want to be responsible for the destruction of our planet, and i hope you don't either.

so join up, lets make a difference. Go to http://protestforchange.tribe.net/ , create a profile, and then join protest for change. Our activities will reflect the views of our members, probably starting with a protest against the commercialisation of Christmas

Thanks,

Hag[]p
